The Serbian Tobacco Law regulates the conditions and methods for the production, processing, and marketing of tobacco, processed tobacco, and processed tobacco in the Republic of Serbia. It specifies the requirements for registration and recording, determines the types of information on the composition and labeling of tobacco and related products within the Republic, and is supervised and enforced by the Tobacco Control Agency. In the past, electronic cigarette products only needed to comply with the requirements of the General Consumer Product Safety Law. Currently, they have been included in the jurisdiction of the Tobacco Law, including nicotine containing and nicotine free electronic cigarette products.

Product restrictions

(1) The capacity for refilling e-liquid shall not exceed 10 mL;

(2) The e-liquid capacity of disposable electronic cigarettes and cartridges shall not exceed 2 mL;

(3) Nicotine concentration must not exceed 20 mg/mL, and nicotine must comply with drug standards;

(4) Electronic cigarettes must not contain any controlled psychoactive substances.

(5) The shape of electronic cigarette devices must not be the same or similar to the shape of toys, food, or beverages.

Labeling and packaging requirements

The packaging must include the ingredients, nicotine content, e-liquid volume, production date, and instructions for use and storage.

Prohibit the use of printed materials, illustrations, or elements related to candy or desserts on product packaging

The packaging must not imply that its harm is less than other products

Warning language requirements

(1) Text requirements

(a) Health warnings for nicotine containing products

(b) Health Warning for Nicotine Free Products

(2) Format requirements:

(a) Displayed on at least one largest surface of the packaging and combination packaging, and cannot be removed;

(b) Covering at least 30% of its surface area;

(c) Write in black bold Helvetica on a white background, parallel to the side edges of the packaging.

The Tobacco Law has now been enforced, with the exception of the aforementioned product restriction requirements and labeling and packaging requirements, which will take effect on January 1, 2025.
