The Therapeutic Goods and Other Legislative Amendments (Electronic Cigarette Reform) Act 2024 was passed and came into effect in the Australian Parliament on July 1, 2024, and the new regulations apply to all electronic cigarette products containing or not containing nicotine. Starting from July 1, 2024, the supply of disposable electronic cigarettes is not allowed, and the flavors of electronic cigarettes are limited to mint, menthol, and tobacco.

A disposable electronic cigarette refers to an electronic cigarette device that has the following characteristics:

Fully assembled and all components permanently fixed in place; also

It is not designed or intended to be detachable; And

Pre filled with therapeutic electronic cigarette substances.

A disposable vape refers to a vaping device that:

 is fully assembled with all the components permanently fixed in place;  and

 is not designed or intended to be disassembled;  and 

 is pre-filled with a therapeutic vaping substance.

Transitional measures

According to information released on the official website of the Australian Department of Health on July 19th, the Australian government has implemented transitional measures to support the government's reform of electronic cigarette product regulation - the Enterprise Return Program. The enterprise return plan allows enterprises to return a specified number of electronic cigarette products (which were legal before July 1, 2024, but no longer legal after July 1, 2024). This program is applicable to enterprises with over 280 electronic cigarette devices, 1800 electronic cigarette accessories, or 12000 milliliters of electronic cigarette e-liquid. Companies participating in the program must notify the Drug Administration (TGA) via email before September 1, 2024, including pharmacy and non pharmacy retailers, wholesalers, manufacturers, importers, exporters, transportation or storage providers.

How to sell legally

Pharmacies can only sell electronic cigarettes that have been approved by TGA, meet product standards, and are listed on the approved electronic cigarette list - that is, electronic cigarettes that have been successfully registered with the Australian Therapeutic Goods Registry (ARTG), or electronic cigarettes that have provided pre-market notification to TGA and entered the approved list before import or supply. Compared to ARTG registration, providing pre-market notification to TGA is relatively simple and has a shorter cycle.
